1. Overview
Royale Decants is operated by Perfume Empire LLC, a North Carolina limited liability company ("Royale Decants," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of royaledecants.com and any purchase you make from us (together, the "Services"). Our store is powered by Shopify.
By visiting our website or placing an order, you agree to these Terms and to our Shipping Policy, Refund & Return Policy, and Privacy Policy, which are incorporated by reference. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age, you may use the Services only with the involvement and consent of a parent or legal guardian.
3. About Our Decants
Royale Decants is an independent fragrance retailer. Our decants and samples are hand-filled from authentic, retail fragrance bottles into our own glass atomizers, then labeled and packaged by us.
- Decants are not packaged, sealed, or distributed by the original manufacturer.
- Fill levels may look different from one atomizer to another because of bottle shape and atomizer design. A small air gap is normal.
- Batches, formulations, and liquid color can vary from bottle to bottle. This is not a defect.
- How a fragrance smells, lasts, and projects depends on skin chemistry, climate, and personal perception, so we cannot guarantee a particular experience.
Unless stated otherwise, Royale Decants is not affiliated with, sponsored by, or endorsed by any fragrance brand shown on our website. Brand names and trademarks are used only to identify the products, and they remain the property of their owners.
4. Product Safety
Fragrances are for external use only. They are flammable, so keep them away from heat and open flame. Do not ingest them, avoid contact with your eyes, and keep them out of reach of children. If you have sensitive skin or known allergies, test on a small area first and stop using the product if irritation occurs. Store fragrances upright in a cool, dry place away from direct sunlight.
5. Personal Use Only
Products are sold for personal use. You may not resell, relabel, or redistribute products bought from Royale Decants as your own, or present them as being sold by the original manufacturer. We may cancel or limit orders that appear to be placed for resale.
6. Product Information & Pricing
We try to keep product descriptions, images, sizes, and prices accurate. Errors can still happen, and images are for illustration. We may correct errors, update information, or change prices at any time without notice. A price change does not affect an order we have already confirmed, except in the case of an obvious pricing error.
7. Orders & Acceptance
When you place an order, you are offering to buy those products. Your order is accepted when we confirm and process it. We may refuse, limit, or cancel any order, including orders with pricing or listing errors, orders that look fraudulent, or orders that exceed quantity limits. If we cancel an order after you have been charged, we will refund the full amount to your original payment method.
8. Payment
Payment is due when you order. By submitting payment, you confirm that you are authorized to use the payment method you provided. Payments are processed securely by Shopify and its payment partners. We do not store your full card details.
9. Shipping
We ship within the United States only. Shipping rates, processing times, and delivery estimates are described in our Shipping Policy. Once a package has been handed to the carrier, delivery times are estimates and are not guaranteed.
10. Returns & Refunds
All decants, samples, discovery sets, and bundles are final sale, except in cases of verified damage, defects, or fulfillment errors. Please see our Refund & Return Policy for eligibility, claim windows, and how to submit a claim.
11. Promotions & Discount Codes
Discount codes and promotions are subject to their stated terms. They cannot be combined unless stated otherwise, have no cash value, and cannot be applied to orders that have already been placed. We may change or end a promotion at any time, and we may cancel orders that misuse a promotion.
12. Accounts
If you create an account, you are responsible for keeping your login details secure and for all activity under your account. Notify us right away if you suspect unauthorized use.
13. Reviews & Submissions
If you submit a review, photo, comment, or other content, you confirm that it is truthful and that it is yours to share. You also give us a non-exclusive, royalty-free right to use, display, and reproduce it in connection with our business. We may remove content that is false, offensive, unlawful, or unrelated to the product.
14. Prohibited Uses
You agree not to use the Services:
- For any unlawful or fraudulent purpose, including false damage or non-delivery claims.
- To copy, scrape, or reproduce our website content, product photos, or listings without permission.
- To upload viruses or malicious code, or to interfere with the security or operation of the website.
- To harass, abuse, or impersonate others.
15. Intellectual Property
The Royale Decants name, logo, original product photography, and website content belong to Perfume Empire LLC and may not be used without our written permission.
16. Third-Party Links & Services
Our website may include links to third-party sites or services. We are not responsible for their content, products, or practices, and your use of them is at your own risk.
17. Disclaimer of Warranties
Except as expressly stated in these Terms or required by law, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement.
18. Limitation of Liability
To the fullest extent permitted by law, Perfume Empire LLC and its owners, employees, and partners are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any product. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.
19. Indemnification
You agree to defend and indemnify Perfume Empire LLC and its owners, employees, and partners against any claims, losses, or expenses, including reasonable attorneys' fees, that arise from your violation of these Terms or your misuse of the Services or products.
20. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in North Carolina.
21. Severability
If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in full effect.
22. Changes to These Terms
We may update these Terms at any time by posting the revised version on this page and updating the "Last Updated" date. If you keep using the Services after a change, you accept the updated Terms.
23. Your Rights
Nothing in these Terms limits any consumer rights that cannot legally be waived.
